Public Offer for the Provision of Burial Site Care Services

1. General Provisions
1.1. This Public Offer Agreement is an official offer by Sole Proprietor Oleksandr Pavlovych Sytnik, operating under the trade name Dbayemo (hereinafter — the "Provider"), to enter into an agreement for the provision of burial site care services on the terms set out in this Agreement.
1.2. The Agreement is addressed to an unlimited number of natural persons, sole proprietors, and legal entities who order services through the website, messengers, telephone, or other communication channels of the Provider (hereinafter — the "Customer").
1.3. Acceptance of the Offer is any of the following actions by the Customer: submitting a request on the website, clicking the order confirmation button, paying an invoice, making a prepayment, or providing written confirmation of the order terms via messenger or email, provided that the Customer was given a link to this Offer.
1.4. Acceptance of the Offer means that the Customer has fully reviewed and agrees to the terms of the Agreement, the Payment and Refund Terms, and the Privacy Policy.

3. Definitions
3.1. "Services" — works and/or services for the care of a burial site: cleaning of the area, removal of waste, weeds, and seasonal contamination, washing of the monument/fence, care of flowers and plantings, placement of flowers, minor agreed works, photo and/or video report, and other services indicated on the website or agreed by the parties.
3.2. "Burial site" — a specific grave, family burial plot, plot, or other object at a cemetery in respect of which the Customer orders the Services.
3.3. "Photo report" — photo and/or video materials taken before, during, and/or after the performance of the Services, which are sent to the Customer as confirmation of performance.
3.4. "Subscription" — the regular provision of Services over a defined period under the selected plan, with regular payment or payment for an agreed period.
4. Subject of the Agreement
4.1. The Provider undertakes, at the Customer's instruction, to provide burial site care Services, and the Customer undertakes to provide the necessary information, pay for the Services, and accept the result in the manner set out in this Agreement.
4.2. The composition, scope, cost, city, cemetery, deadlines, plan, and additional requests are determined on the basis of the Customer's request, information on the website, and/or individual agreement between the parties.
4.3. The Provider does not perform burials, reburials, exhumations, cremations, actions involving the body of the deceased, changes to burial registers, construction works requiring special permits, or other actions not indicated on the website or in an individual agreement.
5. Order Placement Procedure
The Customer selects a plan or describes the required Service on the website, via messenger, by telephone, or by email.
The Customer provides the information necessary for performance: the city, the name of the cemetery, the sector/row/plot number, the full name of the buried person if available, landmarks, photos of the site, the preferred date, and contact details.
The Provider clarifies technical feasibility, cemetery accessibility, the approximate scope of work, the deadline, and the cost.
The Customer confirms the order and makes payment or prepayment in accordance with the terms provided by the Provider.
After performing the Services, the Provider sends the Customer a photo report and, if necessary, an invoice/act/other document.
5.2. If the Customer has provided incomplete or inaccurate data, the Provider has the right to request clarification, postpone the performance deadline, or offer a separate paid service to locate the burial site.
6. Territory and Performance Restrictions
6.1. Services are provided only in the cities, districts, and cemeteries indicated on the website or separately agreed with the Customer.
6.2. The Provider has the right to refuse or postpone the performance of the Services if access to the cemetery is restricted by the administration, government authorities, police, military administration, emergency services, weather conditions, an air raid alert, mine/explosive hazard, or other circumstances that create a risk to life, health, or property.
6.3. Services are not provided to residents of the russian federation and the republic of belarus, as well as to persons subject to sanctions or other statutory restrictions.
7. Cost and Payment Procedure
7.1. The cost of the Services is indicated on the website in hryvnia or determined individually after assessing the scope of work. If the Provider is a VAT payer, the price includes VAT unless expressly stated otherwise. If the Provider is not a VAT payer, VAT is not charged.
7.2. Payment is made by bank card through the payment system, by bank transfer, by invoice, or by another method available on the website and agreed by the parties.
7.3. For one-time orders, a prepayment of 50% or 100% may apply depending on the place of performance, the scope of work, the cost of materials, and the Customer's status. For customers from abroad, a 100% prepayment may apply, with the right to a refund on the terms of this Agreement.
7.4. For a subscription, payment is made monthly, annually, or for another agreed period. If recurring payments are enabled, the Customer separately confirms the amount, frequency, and procedure for cancelling the subscription.
7.5. After receiving payment, the Customer is provided with an electronic document, receipt, fiscal receipt, or other document confirming payment, where such a document is required by law or available in the relevant payment system.
8. Service Delivery Timeframes
8.1. The approximate timeframe for performing a one-time Service is from 1 to 7 business days after receipt of payment and all necessary information, unless another timeframe is agreed by the parties.
8.2. Timeframes may be changed due to weather conditions, seasonal workload, air raid alerts, restrictions on access to the cemetery, the absence of accurate data on the burial site, or other circumstances that objectively affect performance.
9. Quality, Photo Report, and Acceptance of Services
9.1. The Provider provides the Services with care and respect for the burial site, the Customer's property, the cemetery rules, and generally accepted ethical standards.
9.2. Confirmation of performance is a photo report, video report, the Provider's notice, an act of services rendered, or other evidence agreed by the parties.
9.3. If the Customer has comments regarding quality, they must contact the Provider by email or messenger with a description of the comments and, where possible, photos/videos. The recommended period for such a request is 3 calendar days after receiving the photo report, but this period does not limit the consumer's statutory rights.
9.4. If the comments are justified, the Provider, at the parties' choice, free of charge remedies the defects, re-performs the relevant part of the Services, provides a discount, or refunds the funds in full or in part.
10. Cancellation, Refunds, and Subscription
10.1. The procedure for cancelling orders, refunds, postponing performance, and cancelling a subscription is set out in the separate Payment and Refund Terms, which form an integral part of this Agreement.
10.2. If the Services have already been duly performed and the Customer has been provided with a photo report, the funds for the performed Service are not refunded, except in cases of inadequate quality, material non-compliance with the agreed terms, or other cases provided by law or this Agreement.
10.3. If performance is impossible for reasons beyond the parties' control, the Customer is offered postponement of performance or a refund for the unperformed part of the Services.
11. Rights and Obligations of the Customer
provide accurate information necessary for performing the Services;
pay for the Services in a timely manner;
notify the Provider of any special requirements, access restrictions, cemetery rules, or the presence of third parties whose rights may be affected;
receive the photo report and submit any comments;
cancel the order or subscription in accordance with the Payment and Refund Terms.
12. Rights and Obligations of the Provider
provide the Services in accordance with the agreed scope;
handle the burial site and the property on it with care;
provide a photo report, where this is provided for by the plan or agreement;
engage employees, contractors, or partners to perform the Services, while remaining responsible to the Customer for proper performance within the limits of this Agreement;
refuse to perform an unlawful, dangerous, unethical, or technically impossible order.
13. Personal Data and Confidentiality
13.1. The Provider processes the Customer's personal data in accordance with the Privacy Policy published on the website.
13.2. Data on the burial site, photos/videos of the grave, the name of the buried person, family context, and other sensitive information are used solely for performing the order, reporting to the Customer, accounting/legal records, and protecting the rights of the parties.
13.3. Photos and videos of the burial site are not published in advertising, social media, or portfolios without the Customer's separate consent, except in cases expressly provided by law.
14. Liability of the Parties
14.1. The parties are liable for non-performance or improper performance of their obligations in accordance with the legislation of Ukraine and this Agreement.
14.2. The Provider is not liable for impossibility of performance or delay if it is caused by false/incomplete data from the Customer, access restrictions, actions of the cemetery administration, government authorities, military risks, weather conditions, air raid alerts, or other circumstances beyond the Provider's reasonable control.
14.3. The Provider is not liable for the condition of the monument, fence, tiling, vases, decorative elements, or other objects that, prior to the start of work, had hidden damage, wear, corrosion, cracks, unstable fastening, or other defects, where the damage was not caused by the culpable actions of the Provider.
15. Force Majeure
15.1. The parties are released from liability for non-performance of obligations if it results from circumstances of force majeure, in particular war, hostilities, occupation, mine hazard, air raid alerts, decisions of government authorities, natural phenomena, fires, epidemics, blocking of access to the cemetery, or other events that the parties could not have foreseen or prevented.
16. Dispute Resolution
16.1. The parties shall seek to resolve disputes through negotiations and a written request to the Provider's email.
16.2. If a dispute is not settled through negotiations, it is resolved in accordance with the legislation of Ukraine by the competent court.
17. Term and Amendment of the Offer
17.1. The Offer is valid from the moment of its publication on the website until it is withdrawn or replaced by a new version.
17.2. The Provider has the right to amend the Offer. The new version applies to orders placed after its publication, unless otherwise provided by law or by a separate agreement between the parties.
